Madadi: With greeting to all the dear visitors of the website and hope that Mr. Mansour Osanloo and Gholamreza Gholamhoseini will be free soon, I would like to inform that the idea of the Syndicate’s web site was proposed by Mansour Osanloo, he had the most efforts to re establish the syndicate to improve Vahed’s workers’ situation, and after approval by the other syndicalists, the Syndicate’s web site was launched to increase awareness about the trade unionism advocacy activities in July 2004. After the election of the executive board of the syndicate, the website was kept on going and Mr. Mansour Osanloo repeatedly asked all the members of the executive board and the other members as well as all the activists who were interested in the syndicate activities to write for the web site. In spite of many up and downs that we faced because of the members’ detentions, imprisonments and dismissals, especially Osanloo’s imprisonment, the website has been continued to be the voice of the Syndicate of the Workers of Vahed Company. This web site is the moral keepsake of Mr. Mansour Osanloo and it will be his memento.
Question: Mr. Madadi, did Mr. Osanloo give his though about the web site when he was in the hospital?
Madadi: Mr. Osanloo is very interested in the web site and he always considers it as the result of his idea and the achievement of the syndicalism movement. He always thinks how to improve it, as long as I know; he feels very high psychological connection to it. It is the duty of the Syndicate of the Workers of Vahed Company to take of it as his keepsake. We hope that all who are faith full to Mr. Mansour Osanloo’s syndicalism’s idea honestly try to guard this website as the moral heritage of the Syndicate of the Workers of Vahed Company and the first web site of the Iranian workers syndicalism’s movement.
Interpretation of the Worker’s Pledging for Justice to Rioting and Chaos

Following the detention of Gholamreza Gholamhoseini, a member of the Syndicate of the Workers of Vahed Company, in last week, his attorney criticized his detention and the ill treatment by the judiciary officials.
As reported by Dastranj, Parviz Khorshid in reaction to the charges against him with the action against national security through rioting and chaos, said, “How my client could act against national security by himself in such a high secured place. Khorshid added, “Gholamhoseini, is in Evin prison in the sever charges with acting against national security, as an afflicted worker, just wanted to talk to the General Director of Vahed Company and Tehran Mayor about returning him to the job.”
Gholamreza Gholamhoseini, a member of the Syndicate of the Workers of Vahed Company, was arrested last week in Women Day celebration in Azadi 12 thousands seats Stadium where Tehran Mayor and the General Director of Vahed Company was scheduled to be attended.
According to Ebrahim Madadi, a member of the Syndicate of the Workers of Vahed Company, Gholamhoseini was one of those few members of the Syndicate whose dismissal order was broken by the Dispute Board at the Department of Labor, but the employer still refuses to return him to the job.
As khorshid, the attorney of Gholamhoseini, said, “Judiciary officials have been taking hard on Gholamhoseini by the order of detaining which is as hard as the charges have been brought to him, because detention order should be the judiciary’s decision for those who have been accused to murder.” Taking hard on Gholamhoseini has been continued while, today, his family went to the security prosecutor office without getting any results.
We Condemn the Violation of Rights and Detention of Gholamreza Gholamhoseini
Following the management refusal to meet him, Mr. Gholamhoseini went to the Azadi Stadium, where the National Women Day had been celebrating by Vahed Company and Mr. Ghalibaf was the speaker, to meet the manager of the Vahed Company at 8:00 pm on June 24, 2008. Unfortunately, in the coordinated action between the intelligence office at Vahed Company and Najafzadeh, officer of the Security Police, he was insulted and arrested and taken to the second base of the Security Police at Jalal Alahmad street where he spent the night while he was beaten by the commanders of the night shift. He was ordered to be transferred to the solitary confinement in Evin prison by Judge Hadad in charge of “acting against security’ at 4:00 pm on June 25, 2008.
The Syndicate of the Workers of Tehran and Suburban Bus Company strongly condemns the ill treatment by the officers of the security police and the detention of Mr. Gholamreza Gholamhoseini, a hard working worker with 3 children and tenant in Ghalehasan khan [an area far from Tehran], and calls for his immediate and unconditional release.
The Syndicate of Workers of Tehran and Suburban Bus Company urges the country’s high level authorities, especially at the Ministry of Labor who claim that the labor organizations are free, as well as country and international trade unions, especially ITF and ITUC and the related committees at ILO, and all the organizations and individuals who are seeking democracy and justice, to launch a wide efforts for Mr. Gholamhoseini’s immediate and unconditional release.

Mansour Osanloo Was Transferred to the Health Base at the Evin Prison
Regarding the governmental report, published by ISNA, Iran Students News Agency, and Dastranj, about the detention of Mansour Osanloo and national and international support from him, it should be informed that:
Same as every year, the members of Iran delegation to the Annual International Labor Organization Conference falsely reported, was published by ISNA and Dastranj, that the representatives of Jordan, Iraq and Lebanon at the ILO conference didn’t support the protest statement in which the freedom of Mansour Osanloo was requested, and it was signed by the majority of the countries’ representatives. However, the representatives of Iraq, Jordan and Lebanon in ILO said that they, along with the representatives from Palestine, Bahrain and Tunisia, supported Osanloo. More over, they were wearing the badges of free Osanloo with his photo, as well as they had expressed their support from Osanloo in this conference.
ILO in its 59- page report, published recently, obliged the Islamic Republic of Iran to investigate regarding several complaints in last couple of years, as well as respect the workers’ right to organize, return the dismissed workers and drop all the charges against workers in Iran.
We hope that authorities in Iran, as a member of the International Labor Organization, comply with the ILO’s Conventions. More over, we hope that Mansour Osanloo, the president of the Executive Board of the Syndicate, will get free, and the dismissed members of the Syndicate, the other labor activists as well as all the workers who have been dismissed because of their defense of workers’ trade union’s rights will be returned to their jobs soon.

Further more, Osanloo stated that, as he didn’t know doctors in the other hospitals and he wouldn’t be able to trust them easily, and according to the right of patient to select doctor, if he has been forced to be transferred to any other hospitals except Labafinejad he would have got to hunger strike to defend his human and patient’s rights. He mentioned that his death would show the real face of the Security Deputy of Tehran Revolutionary Court to everyone all around the world.
II.During all the time that Osanloo has been in the hospital, one of the armed guards was on his bed with gun even at the CCU and his presence with gun has been caused anxiety and stress for the other patients and personnel at the CCU. Obviously, this is the violation of patients’ morality and human rights at the Critical Care Unit.
Ignoring these basic civil and patient rights by the authorities of the Revolutionary Court is illegal, and indicates an overt attempt above the law to this ill treatment with the president of the Syndicate of the Workers of Vahed Company.
III.The primary order, issued by branch 14 of Revolutionary Court, and any copies has not been submitted to Osanloo and any of his lawyers, Dr. Mowlaiee and Parviz Khorshid.
IV.Osanloo’s attorneys have not been permitted to visit him in the prison for last 7 months. Osanloo has been denied to sign the client- attorney agreement which is required to implement article 18 for representing him in his trial procedure. This action which is against principals 34 and 35 of the Constitution, would violate the right to be defended. The real reason behind this behavior is preventing Osanloo’s case to be appealed at the Supreme Court.
The baseless ness of the order and lack of legal evidence and reasons in the issued verdict are the reasons of depriving of carrying a copy of the order by the accused person.

Happy May First, International Labor Day
As an international tradition, in all countries, workers express their demands and protests through the observances of International Labor Day. Governments in all the countries are aware of the importance and sensitivity of the International Labor Day, and they respect it by fixing May First as a national holiday and celebrating it in public.
In Iran, with a more than a century syndicalism history, started during civil revolution and continued during the oil nationalizing and the recent revolution, sorrowfully, workers are deprived of their legitimate rights to be organized within the independent labor syndicates, despite the fact that there is any legal obstructions, and this is not the honor for a country which is a member of ILO for more than half a century.
The Syndicate of Workers of Tehran and Suburban Bus Vahed Company is appealing authorities of three governance powers to end repressing and preventing syndicalism activities, release Mr. Mansour Osanloo, the president of the Executive Board of the Syndicate, and take proper measures to return the members of the Syndicate of Vahed to their jobs.
The Syndicate of Workers of Vahed Company supports all the rights seeking actions of workers in Iran and all around the world, and thanks all the workers, global trade unions, including International Trade Unions Confederation (ITUC) and the International Transport’s Workers Federation (ITF), and all the people who are seeking democracy, justice and peace for their collaboration to defend our rights.

As reported by Dastranj, the Public Outreach of the Syndicate of the Workers of Vahed Company announced that Ebrahim Nouroozi Gowhari, a member of the Syndicate, would attend the branch 14 of the Revolutionary Court.
The reason of this summons is his participation in the trade unionism’ protest of workers of Vahed Company in 2005. His case is one of those 16 files which had been opened in the judicial system for their protest in 2005.
In the winter of 2005, the workers of Vahed Company went to strike because their trade demands had not been fulfilled. During this protest, many of the workers, including the members of the Syndicate of Workers, were arrested by the disciplinary agents. After a while, the judicial system ordered to stop prosecution of detained workers, and many of them were returned to their previous job; still, sixteen of workers have their files open.
Mansour Osanloo, Ebrahim Madadi and Ali Zad Hosein are some of those workers whose cases were tried by the judicial system. Mansour Osanloo, the president of the Syndicate, is serving his 5 – year prison sentence. Ebrahim Madadi, the vice president of the Syndicate, as it was said, has been sentenced to three years and a half term prison, but he has not received the verdict yet. Ali Zad Hosein, a member of the Syndicate, was sentenced to 10 – month suspended prison a while ago.

Mansour Osanloo, labor activist and president of the Executive Board of the Syndicate of Workers of Tehran and Suburban Bus Vahed Company, is in jail for his workers’ rights activism, was visited by his family and members of the Executive Board of the Syndicate on April 27 when he was transferred to Labafinejad hospital in Tehran.
Reza Shahabi, a member of the Executive Board of the Syndicate, about this visiting said to DW, “Today, Mr. Mansour Osanloo was transferred from the prison to the hospital to check up his eye. Members of the Executive Board and his family visited him.”
Reza Shahabi explained that Osanloo was in a good spirit. He said that he was really very happy and determined when he was talking with his family and the members of the Executive Board. As Shahabi said, Mansour Osanloo, once again, emphasized on the slogans which reflect workers’ demands, and workers have been trying to fulfill their human rights in Iran for several years. That is, Decent Life and Independent Labor Organizations as the Absolute Workers’ Rights.
Reza Shahabi added that Osanloo reminded May Day, International Labor Day, as the Solidarity Day for workers in Iran and the globe, and he asked all workers to stand up together, hand in hand, united and with their solidarity, to defend their fundamental rights, right to organize their independent labor trade unions and decent life. Osanloo expressed his hope that, “If workers speak with one voice and make authorities to hear it, we will achieve to our legitimate rights, workers rights and independent labor organizations.”

The Order of 6 Month Suspended Prison Sentence for a Labor Activist

News- The Court of Revolution sentenced one of the members of the Syndicate of Workers of Vahed Company to 6 months suspended prison.
As reported by Dastranj, Syndicate of Workers of Vahed Company informed that Gholamreza Gholamhoseini, a member of the Syndicate, was sentenced to 6 months suspended prison in charge of distributing the Syndicate’s leaflets by the Court of Revolution.
Gholamhoseini was informed about the order of his 6 month prison sentence, had been suspended for 5 years, in charge of propaganda against regime and acting against national security by the Court of Revolution, branch6, verbally on March 9, 2008
He was arrested while he was distributing the Syndicate’s leaflets at the Sadeghieh Metro Station in Tehran on May 13, 2006 and was transferred to Tehran’s Security Police.
In reaction to his sentence, he told Dastranj, “I haven’t committed any crimes and I will appeal within 20 legal days.”
The Syndicate of Workers of Vahed Company, also, in reaction to this order, announced that the leaflet which was distributed by the member of the syndicate when he was arrested was about demanding Osanloo’ release and it didn’t include anything which could be referred as propaganda against the regime or acting against the national security.
Dr. Parviz Khorshid, Gholamhoseini’s attorney, also, said, “My client was carrying out a trade union activity while he was arrested, and charging him with propaganda against the regime is not acceptable.” He added, “Propaganda against the regime can be referred when the continues analytical articles in a negation of all the system as a whole were published by the accused person.” As Khorshid said, there was anything in the Syndicate’s leaflets which could be considered as propaganda against the regime. He recalled that criticizing a system by addressing it directly in any printed materials could not be recognized as propaganda against the regime. By stating that he would appealed the sentence, he, also, criticized the procedure of the Court of Revolution in which all the cases were approached from the security angle.

News- Two members of the Executive Board of the Syndicate of Workers of Tehran and Suburban Bus Vahed Company were transferred to the Court of Revolution by Tehran Public Security Police this morning today.
Saeed Torabian, Syndicate’s spoke person, and Mohammad Ebrahim Nourouzi Gowhari, a member of the Executive Board of the Syndicate of Workers of Tehran and Suburban Bus Vahed Company, this morning, after presence at Tehran Public Security Police and answered some questions, were transferred to the Court of Revolution.

Two members of the Syndicate of Workers of Vahed Company, this morning, after presence at Tehran Public Security Police, branch 14, locates at Sepah Square- Tehran, and answering some questions about the newsletter of the Syndicate, entitled Syndica Paeyk (Syndicate’s messenger), were transferred to the Revolutionary Court, chamber 2 especial for security, locates at Moalem Avenue- Tehran, for more interrogation.
As Torabian said, “Paeyk Syndica is an internal monthly newsletter of the Syndicate of Workers of Vahed Company which has been printed in the limited copies - about 200, since October 2007. Most of the pieces, including letters to the Judiciary authorities, training articles about Labor Law and Constitution, internal news at Vahed Company and the other articles, have been written by members of the Syndicate.” The spoke person of the Syndicate about the way of publication said,” Until now, four volumes of Paeyk Syndica have been published. Twenty copies of each volume usually are printed, then, ten copies would be made by each member of the Syndicate.”
Regarding Nourouzi and Torabian’s presence at Tehran Public Security Police Office and the Revolutionary Court, Torabian said, “According to the summons’ letters, we went to Tehran Public Security Police Office, branch 14. After we answered the proposed questions about the Syndicate’s news letter, Paeyk Syndica, we were transferred to the Court of Revolution, branch two especial for Security, by the agents of the Security Police.” The Syndicate’s spokesperson added,” In the Court of Revolution, after we answered the questions which were proposed by the Judge of this case, only we were said that we would be informed, and without any other orders, we left the Court.” He stated that according to the judge, there was not any claim against the Syndicate’s newsletter, Paeyk Syndica; however, he informed that some of the other members of the Syndicate were summoned to Tehran Public and Security Police Office.
Parviz Khorshid, the attorney of the members of the Syndicate of the Workers of Vahed Company, about the latest summons on Torabian and Nourouzi Gowhari to Tehran Security Police said to Dastranj, “As these two left the Revolutionary Court without any orders, it can be said that, at the moment, they haven’t been faced with any charges.”
Congratulation Message in occasion of Mahmoud Salehi’s Freedom
Mahmoud Salehi, Former member of the Bakery’s Workers Union in Saqez city, was in jail according to the order by the Revolutionary Court in Saqez for more than one year, and was released on $44,000 bail, today, Sunday April 6, 2008, at 3:00 pm local time.
We congratulate his freedom to the workers in Iran and all around the world, his family and workers’ rights activists. We hope that we celebrate the release of Mr. Mansour Osanloo, president of the Syndicate of the workers of Vahed Company, soon.

Khorshid, the Syndicate’s Attorney who defends Ebrahim Madadi as well, said, “Despite of the fact that Ebrahim Madadi’s order, regarding the case was filed in 2005, has not been sent to us, my client has received a letter to be appeared at the Sentence Enforcement Office.
Mansour Osanloo, an imprisoned labor activist, was visited by his attorney at the hospital.
Paviz Khorshid, by giving this news to the legal reporter of the ISNA, said, “After my client was transferred to the hospital for the eye surgery, I visited him yesterday at the hospital.” He added, “Mansour Osanloo was transferred from the Evin Prison to the hospital last Thursday and had a heavy operation on his eye. According to the doctors’ recommendations, he should be under the medical control for five weeks, but his vocation has been extended until the next Saturday.”
Mansour Osanloo’s attorney recalled, “We, I along with his family, submitted the request of extending his vocation to prevent any negative consequences of the surgery.”
As the authorities at the Labor Ministry didn’t answer to the complaints of about 50 dismissed workers of the Vahed Company and their follow up, these workers have gone to the offices so many times, and several protests have been staged since 2005. Following these incidents, Abbas Mohammadi, Adviser to the Head of Tehran Province Labor and Social Affairs Department, filed a case in the judicial system against Ebrahim Madadi, the Vice President of the Syndicate of the Workers of Tehran and Suburban Bus Company who was officially in charge of the following up the workers issue on behalf of them, in the summer of 2007. So, Ebrahim Madadi would be tried based on this complaint at the Shahid Beheshti Judicial Complex, chamber 1060, on January 31, 2008.
It should be mentioned that Ebrahim Madadi had complaint against this authority in the judicial system as well.

On January 2008, Yagoub Salimi, a member of the Executive Board of the Syndicate of the Workers of Tehran and the Suburban Bus Company, Vahed, attended the meeting that Iran President had with the clergy’s group in the old building of the Islamic Council Parliament. He was able to talk to the President personally, and raise the issue of the 26 suspended workers as the Syndicate’s members, and inform him about their problems, and ask him to solve them.
The president issued the order of the required investigation to Mr. Zaribafan and Mr. Esfandiari, and these authorities, by getting the contact information of some of the workers, promised to solve their problems until end of the next week.

Osanloo Was Transferred from the Prison to the Hospital
Etemad e Meli, January 3, 2008- Mansour Osanloo, a labor activist at the Vahed Bus Company, was transferred to the hospital because of his eye problem on Tuesday morning this week.
Mansour Osanloo, one of the labor activists, presently in jail, was transferred from the health base in Evin prison to Labafinejad hospital for the second treatment on his left eye by laser. His doctor, after the treatment, recommended the surgery on January 26, 2008.

Ebrahim Madadi, labor activist, by stating that he has been summond to the Revolutionary Prosecutor Office, branch one, said that he was told in the meeting that he has been charged with the disturbing the order. Madadi in the interview with the ISNA legal reported said, “Last year, I along with the other labor activists had gone to the Labor Ministry to follow up our petition, and some of us were arrested when we were coming back.” He added, “This is the reason of the case has been filed in the branch one of the Security at the Revolutionary Prosecutor Office. This morning I was told that I have been charged with disturbing the order, abnormal behavior, creating uproar, and gathering in front of the Ministry of Labor.”

Mr. Ebrahim Norouzi Gohari, a member of the Executive Board of the Syndicate of the Workers of Vahed Company, had proposed a claim to the Judiciary Organization of the Military against the police officer who had beaten him in front of Mr. Osanloo’s house on August 9, 2007, was tried as a first time in the Military Prosecutor Office with presence of the officer who had beaten him. The Judiciary Officer ordered a medical research.

Sayed Reza Nematipour, a driver of the Ward 5 of the Vahed Bus Company and a distinguished member of the Syndicate of the Workers of Vahed Company, has been summoned to the Interrogation Office, chamber one of the Security on December 30, 2007 to offer his last defend in charge with the disturbing the order by gathering in the Labor Ministry, the case had been filed in the Interrogation Office branch one of the Security, following the gathering along with the other workers in the building of Labor Ministry, his arrest and couple of day detention on July 15, 2006.

In relation to the Vahed Company Workers’ Protest in winter 2005, the cases of 14 members of the Executive Board of the Syndicate of the Workers of Vahed Company at the chamber 14 of the Court of Islamic Revolution are still open and the trials take place in turn. Naser Gholami, a driver of the ward 10 of Tehran Bus Company with more than 20 - year experience and a member of the Syndicate’s Executive Board who has been suspended since the protest, has received a summons from the Court of Islamic Revolution, branch 14, and should be appeared at the court on January 6, 2008.
It should be mentioned that the other members of the Syndicate including Mr. Mansour Osanlo had been tried in this court and presently he serves his five – year sentence.

A Labor Activist informed on his summons to the prosecutor office
Ebrahim Madadi, the labor activist, was summoned to the Revolutionary Interrogation Prosecutor Office, chamber one. Madadi told ISNA Legal Reporter, “According to the summons that I have received I should attend the branch one of the Revolutionary Prosecutor Office.” He recalled, ‘Any charges or reasons have not been mentioned in this summons.”

Ebrahim Madadi, the Vice President of the Syndicate of the Workers of Vhaed Company had been arrested in front of Osanloo’s house on August 9, 2007 when, in response to the International Trade Unions’ call, he was about entering to Mansour Osanloo’s house, President of the Syndicate. He was tried in the Court of Revolution, Chamber 28, and sentenced to two years prison. Ebrahim Madadi and his attorneys, Dr. Yousef Mowlaie and Parviz Khorshid, protested at the verdict and the case was sent to the Court of Appeal. The Court of Appeal, chamber 44, dropped his charges and his guiltlessness order was sent to the Ghezelhesar prison, and he was released on December 16, 2007 at 10:30 PM from Ghezelhesar after being kept 127 days in prison.

Meeting of the European Union Representatives with the Suspended Workers of the Vahed Company
Saied Torabian added, “In the meeting of the families of the 53 suspended workers of the Vahed Company with the delegation of 11 representatives of the European Union, the background of the trade union activities of the workers at the Vahed Company and the reasons of these activities were discussed. “
Eliminating the restrictions of the activities of the members of the Syndicate, restraining all the dismissed workers because of their trade union activities, and establishing the free independent trade union were the major issues in the meeting, as the in charge of the public relation of the 53- suspended workers of the Vahed Company said. He added, “The Deputy of the European Union’s Parliament and one of the Trade Union activists from Spain, were among the 11 – member delegation, promised that they would take action to solve this problem in their negotiations with the Iranian Authorities.”
Torabian said, “In spite of the fact that the efforts of the 53 suspended workers had no results, they are still optimistic in solving their problems, and they welcome to use any opportunities to solve the problems.” He added, “The 11 – member delegation of the Representatives of the European Union came to Iran to investigate of the social, economical and political issues in the result of the previous delegations. As they stated the problem of the suspended workers of the Vahed Company is one of the reasons of their trip to Iran.”

Visiting of the European Union’s Representatives with the Families of the Imprisoned Workers
Yesterday evening, by the coordination of the Portuguese embassy, the opportunity was developed for the members of the workers’ organization of Vahed Company and the spouses of Madadi, Osanloo and Salehi to propose their problems with the members of the European Union. The workers‘ leaders of the European Union were among the eleven – member delegation, and this created the situation to discuss on the independent workers’ organizations and the solutions of the upcoming problems. This delegation, at the Coordinator Office of the United Nations, stated that they would follow up the workers’ problems through the authorities of our country in the next few days.

a. In the issued indictment, there has not been given any reasons to prove that conspiring collectively has been taken place. The statements of the accused person, the officers’ report and the contents of the file have been referred as the reasons of issued verdict in the indictment. The accused person, in all the interrogation meetings and in his defence at the court, clearly stated that he intended to go to Osanloo’s house and he was arrested before he entered in. The reports by the officers and agents also indicated that Mr. Madadi was arrested before he entered to Osnaloo’s house.
b. Conspiring and gathering requires of the participation of at least two people. In the present case, nobody has been sentenced as the Madadi’s accompany in the gathering and conspiring. Whereas if the gathering and conspiring had been taken, Mr. Madadi along with the other people who gathered and conspired with Madadi as partners, assistants or supervisors, should be tried within the one case. The arrested people along with Mr. Madadi were freed with the order to stop further following up.
c. The material element of the attributed crime, which had not been reasonably proven by the court, was replaced with the intention of the crime, and Mr. Madadi, according to the issued indictment, was sentenced because he had the intention of disturbing the national security. Regardless of the fact that the mental element can not be referred as a reason in the absence of the material element, in this case, the court denied to submit the reasons of the criminal intention.
d. Most part of the indictment has been allocated to the client’s trade union activities at the Syndicate of Vahed Company which indicates that action of going to Mr. Osanloo’s house by my client has no criminal dimension and the client has been sentenced because of the charges irrelevant to this case, and it is against the principles of the fair trial, procedure of the criminal trial, and civil rights and respect the legal and legitimate freedom.
e. If we accept that the assumption of Mr. Madadi’s intention of gathering in front of Mr. Osnaloo’s house had been proven, regardless of the fact that any gatherings has not the criminal attribution and only the gatherings which led to the crime should be followed up, as the Disciplinary Forces arrested Mr. Madadi before he entered to Mr. Osanloo’s house, this criminal action can be considered as the abortive crime and maximum the start point of the criminal action for which no sentences had been predicted, according to the law.
2. Criminal Mental Element of Article 610
Referring to the article 610, a crime can be considered if, first of all, the intention of the accused person to conspiring and gathering to be known, and secondly the intention of criminal action (action against the security) through the conspiring to be proven. The respected court in any of the mentioned matters has not submitted any reasons, and has not proven the specific or public intention by the accused person.
Therefore, regarding this bill of defence and referring to Principle 27 of the Constitution of Law, we request the order of breaking the issued verdict, and writ of guiltlessness of the accused person from the attributed charges. Also, for more information, the legal issues of the Article 610 are being described to the esteem Court of Appeals as follows:
1) Material Element in Article 610
Offence of gathering and conspiracy for commitment of an offence will be materially realized when at least two people jointly commit an offence. In other words, the main and key element of realization of provisions of this article is commission or omission of a criminal act by individuals and on the other hand the consequences of these crimes or their effects should be damaging and undermining the country’s security. In this article the criminal act is defined as activities and doings with special particulars which considering the intensity of the act and its consequences, they are considered as dangerous offensive acts. For example creating fear and danger, committing wicked acts, using cold and warm arms, robbery, kidnapping are some of the examples of such crime. In this case, in addition to criminal act, the means and method of commitment and partnership of at least two people are required in what is considered a crime under article 610, and thus it is logically impossible to regards our client’s activities which include giving lectures, issuing statements and holding Syndicate meetings as examples of crime under 610. His behavior and activities have not the criminal description. Establishing Syndicate with the votes of the majority of the workers at the Vahed Company is not a crime. Participation and gathering of the workers at the Vahed Company for their trade union affairs and claim the trade’s rights, according to Principle 26 of Constitution of Law, can not be considered a crime.
2) Mental Element
Considering the mental element of crime, it should be mentioned that the subject of article 610 is public offence, its conditions will be satisfied taking into consideration the criminal intention and its consequences in internal security. In other words the perpetrator should commit the crime intentionally and jointly wit at least one another person and in addition he should have bad intention in his deeds.
In a situation that none of the Syndicate activities are considered as offence and supposedly if the Syndicate is not officially recognized, it will not benefit from any legal privileges. Thus, my client has not committed any crime in his Syndicate activities and recognition of his bad faith, general or particular subject of article 610 is nonsense. As reflected in the records and our client has announced in the court, the objective and intention of the client and other members of the Syndicate have always been defending legal trade rights through peaceful activities and the result of such activities is reinforcement of national security through preventing the claims of deprived layers of the society to be radicalized. Defending the workers’ rights with good faith is an evident of his good faith in organizing the affairs of his area of working and removal of managerial deficiencies, and finally Mr. Madadi’s deeds and behavior has been in the direction of justice benevolence. There is no trace of bad faith and consequently article 610 does not apply to his case.
Syndicate of Workers of the Tehran and Suburban Bus Company, Vahed, strongly condemns the unfair verdicts of five years prison for Mansour Osanloo, because of his trade and syndicalism’s activities, and two - year prison sentence for Ebrahim Madadi, only because he went to Mansour Osanloo’s house to express his sympathy with his family, and requests all international labor organizations to react seriously to this unfair and anti-workers decision globally.

Free Two Imprisoned Syndicalists
Dear Esteemed Judiciary Authorities!
The principle 165 of Constitution of Law requires all trials to be open to the public with the presence of defending attorneys. Why were the cases tried in these hearing while none of the attorneys, families, and workers of the Vahed Company was in present, in order to find out for which criminal activities the members of the Syndicate’s Executive Board were sentenced?
Why do you think that the activities of the two members of the executive board of the Vahed’s Syndicate are against national security? Why are the defenders of the legitimate rights of workers at Vahed Company, who live under the poverty line and should receive more attention, being treated with oppression and unkindly? How long would the trade and syndicalism’s activities pay this large amount of cost? At the moment, more than 30 workers of the Vahed company have been suspended and they are financially embarrassed, and about 13 of the workers have received the reinstate orders from the board of dispute resolution of Labor Ministry, but the managers of the Vahed Company denied to accept them. These workers are the hardest workers in the society and are in a hard living condition.
We ask the esteemed head of the judiciary power to free the two imprisoned syndicate’s workers immediately.
